1. Acceptance of Terms
By downloading, installing, or using Amino ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Amino. By using the App, you represent and warrant that you meet this requirement.
3. Subscription & Payments
Amino requires an active subscription to access core features. Subscriptions are managed through Apple's App Store and processed by RevenueCat. By subscribing you agree to:
- Pay all fees associated with your chosen subscription plan.
- Allow automatic renewal at the end of each billing period unless cancelled at least 24 hours before the renewal date.
- Manage and cancel your subscription through iPhone Settings → Apple ID → Subscriptions.
All purchases are final and non-refundable except as required by applicable law or Apple's refund policies.
4. Health & Fitness Disclaimer
Amino is not a medical application and is not intended to provide medical advice, diagnosis, or treatment. The workout programs, fitness tests, and AI coaching insights are provided for general fitness and informational purposes only. Nothing in the App constitutes professional medical advice.
By using the App, you acknowledge and agree that:
- You must consult a licensed physician or qualified healthcare professional before beginning any exercise program, particularly if you have cardiovascular disease, diabetes, hypertension, joint or muscular issues, pregnancy, or any other condition that may be affected by physical activity.
- Exercise carries inherent risks, including but not limited to muscle strain, joint injury, cardiovascular events, and in extreme cases, serious injury or death. You assume all such risks voluntarily.
- Stop exercising immediately and seek emergency medical attention if you experience chest pain, difficulty breathing, severe dizziness, fainting, irregular heartbeat, or any other alarming symptoms.
- The AI-generated workout plans are not tailored to your medical history and cannot account for undiagnosed health conditions.
- You are solely and entirely responsible for evaluating your physical condition and fitness to perform any exercise suggested by the App.
We expressly and unconditionally disclaim all liability for any injury, illness, physical harm, psychological harm, disability, or death — whether direct or indirect — that may result from your use of, or reliance on, any content, workout plan, coaching insight, or recommendation generated by or provided through the App. This disclaimer applies regardless of whether such harm results from our negligence or the limitations of AI-generated content.
5. AI-Generated Content
Workout programs, coaching insights, and recommendations in Amino are generated by artificial intelligence (Google Gemini). AI-generated content:
- Is provided "as is" and may not always be accurate, complete, or appropriate for your individual circumstances.
- Should not replace the judgment of a certified personal trainer or healthcare professional.
- May vary between sessions as the AI model evolves and is updated.
We make no guarantees regarding fitness outcomes, performance improvements, or weight loss results from using the App.
6. User Responsibilities
By using the App you agree to:
- Provide accurate information in your profile so the AI can generate safe and appropriate recommendations.
- Use the App only for lawful, personal, non-commercial purposes.
- Not attempt to reverse-engineer, decompile, or tamper with any part of the App or its backend services.
- Not share your account credentials with others.
- Not use the App in any way that could damage, disable, overburden, or impair our servers or services.
7. Intellectual Property
All content, design, graphics, code, and other materials in Amino are the exclusive intellectual property of Amino and protected by applicable copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from any part of the App without our prior written consent.
AI-generated workout plans and insights are licensed to you for personal use only and may not be redistributed or sold.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Amino and its creators, employees, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to personal injury, bodily harm, death, loss of data, or loss of profits.
We bear no responsibility whatsoever for your physical health, safety, or wellbeing. You use the App entirely at your own risk. The App is a software tool, not a substitute for professional medical supervision or the advice of a qualified personal trainer.
Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
9. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may stop using the App at any time. Deleting the App does not automatically cancel your subscription — you must cancel through Settings → Apple ID → Subscriptions.
10. Governing Law
These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.
